High Court stays Police Commissioner’s decision
to revoke orchestra licence
Mumbai (Editor Sunil Patil) : Malad in Mumbai city suburb, Mood and Kaka bar Both the hoteliers have got a relief as the Bombay High Court stayed the order given by the Mumbai Police Commissioner regarding the cancellation of the orchestra license in respect of the two bars . Acting on the information of the informants, the police registered a case and issued a show cause notice alleging that the orchestra owners were violating the rules and canceled the licenses of both the orchestra bars in the month of June.Both bar operators against this decision filed petiton in bombay High Court through Adv.Jeevandatt Argade,during the hearing of the petition filed court has stayed the decision of the Mumbai Police Commissioner after hearing the arguments of both the parties.
The licenses of both the bars were revoked by the Mumbai Police Commissioner at the end of the final hearing by issuing a show cause notice on the charges of embezzlement, indecent dancing of women, and other violations. Mere criminal record does not constitute a violation since the appeal is pending in the Ministry of Home Affairs, Government of Maharashtra, that the conviction of the crime recorded has not been proved, and therefore no preliminary conclusions can be drawn when the charges of the crime are sub judice. Both bar ‘Mood’ and ‘Kaka’ renowned hotel operators from Malad petition was filed in the High Court through Adv.Jeevandatt Argade. In this petition, the High Court has given a big relief to the hotel operator by staying the decision of the Police Commissioner.
